The U.S. Senate has confirmed David Fink, the former CEO of Pan Am Railways, as the 16th Administrator of the Federal Railroad Administration (FRA). He was part of a block of 107 nominees who were confirmed in a 51-47 party-line vote on October 7.

During his Senate hearing on May 13, Fink testified that he would support the FRA’s minimum crew size regulation in response to a direct question from Sen. Ed Markey (D-MA). In that same hearing, senators questioned Fink about a history of safety issues at Pan Am, including a worker death in May 2021 and a serious employee injury in January 2022. In both cases, Pan Am said the workers were at fault.
