OTTAWA — The Federal Court of Appeals has upheld the former Liberal government’s second attempt to fire Via Rail chairman Jean Pelletier.

The decision overturned a lower-court ruling last March which sided with Pelletier after he was fired in December 2005.

The case could now be appealed to the Supreme Court of Canada.

The December dismissal was the Paul Martin government’s second try at firing Pelletier over remarks he made about former Via employee and onetime Olympian Myriam Bedard.

The first try — in March 2004 — was also overturned by the Federal Court.
