KANSAS CITY, Mo — The Equal Employment Opportunity Commission has sued BNSF Railway Co., alleging disability discrimination. The charges stem from a failure-to-hire instance in 2008. According to the lawsuit filed in U.S. District Court in Kansas City, Kan., BNSF refused to hire Kent Duty, a Kansas City area resident, as a locomotive electrician because the company thought he was disabled and unable to perform the functions of the job, which include using tools and climbing ladders safely.
