MONTREAL — As Quebec prosecutors filed charges of criminal negligence causing death against three employees and a railway company in the Lac-Mégantic disaster, previous cases suggest the Crown faces a steep challenge in proving the 47 deaths last July 6 were the result of employees’ criminal conduct. And though convictions of companies are theoretically easier since Canada’s Criminal Code was amended 10 years ago as a result of the Westray mine disaster in Nova Scotia, they remain rare.
