BURLINGTON, Iowa — It will be next year before a federal lawsuit that pits the city of Burlington against the Burlington Northern and Santa Fe Railway Company heads to court.

The trial, which had been set for November, is now scheduled for April.

The city is suing the railroad over an agreement that dates back to 1858. Burlington claims the railroad broke a contract that stipulates the railroad could use city land as long as it kept its repair shops in town.

The railroad has eliminated or transferred more than 400 jobs out of Burlington. The lawsuit seeks rent for use of the land.
