WILMINGTON, Del. — Railroad company Norfolk Southern has gone to federal court in a legal battle with the city of Wilmington over stormwater utility fees.

The city claims the Norfolk, Va.-based company owes almost half a million dollars for unpaid stormwater assessment charges, penalties and interest. It is threatening to seize Norfolk Southern’s Edgemoor rail yard property on Railcar Avenue and take it to a sheriff’s sale.

Norfolk Southern says it does not owe the money because stormwater from the property does not run into the city’s stormwater system.

The company also says the city’s plan to sell the property at a sheriff’s sale violates federal interstate commerce laws.
