MONTREAL — But beyond the specific unfairness of the Lac-Mégantic charges, there is a greater concern. A basic tenet of the criminal law is that only those whose conduct is the most significant cause of the crime should face its coercive consequences. A trend of focusing on those easiest to catch, rather than those most culpable, will only undermine the legitimacy of future efforts to apply the criminal law to situations like Lac-Mégantic.
