WASHINGTON, D.C. — A multibillion- dollar antitrust suit alleging four major U.S. freight rail operators conspired to impose a uniform fuel charge on shipping customers reaches a crucial point on May 3, when a federal appeals court in Washington considers whether the case can proceed as a class action.
BNSF Railway Company, CSX Transportation Inc, Norfolk Southern Railway Company and Union Pacific Corporation are defendants in a lawsuit alleging they conspired to impose a uniform fuel charge on shipping customers from July 1, 2003, through Dec. 31, 2008. The railroad companies have appealed a district court judge’s decision allowing some 30,000 direct customers, including the eight named plaintiffs, to sue them collectively.
