SAN ANTONIO, Texas — An out-of-court settlement has been reached between Union Pacific railroad and a Bexar County man injured in a 2004 train derailment.

The agreement came Tuesday night after a jury was unsuccessfully seated and several hours of negotiations between both parties.

Details of the agreement were not disclosed.

“My client is satisfied with the settlement,” said George Legrand, who was representing the plaintiff, Kenneth Schoenfield.

The plaintiff took Union Pacific to court over a train derailment in southwest Bexar County in June 2004 that killed three people.

Schoenfield, who lived near the scene of the derailment, claimed that he inhaled chlorine gas that leaked from the tank cars.

“His lungs will never be the same,” Legrand said.

There are still other lawsuits related to the derailment that are awaiting trial.
