MIDLAND, Texas — The legal battle between victims of the Nov. 15 train wreck and Union Pacific continues as the railroad company responded on April 2 to the plaintiffs’ objection of naming the city, county and Show of Support as responsible third parties. The document, submitted by John Proctor, an attorney representing UP, states that the railroad company has satisfied, and far exceeded, the “lenient” fair notice pleading standard and maintains that the court should grant the third party designations.
