WASHINGTON, D.C. — Officials today filed their arguments opposing CSX Transportation’s bid to overturn the city’s ban on hazardous rail shipments.
D.C. Mayor Tony Williams signed a law in February banning shipment of hazardous materials near the U.S. Capitol. City officials are concerned that a terrorist attack on such a train would kill thousands.
CSXargues that it would be unfairly burdened by rerouting trains through other states. The freight railroad also believes the law is unconstitutional, contending that only the federal government has the right to regulate interstate commerce.
The U.S. Justice Department is siding with CSX.
A federal judge ruled Monday in the city’s favor, but CSXis appealing to the U.S. Court of Appeals for the District of Columbia. The appeals court granted CSX an emergency injunction preventing the city from enforcing the law until the court can rule.
CSX was also due to file arguments today.
D.C. officials are hopeful that there will be a ruling by Monday.
